    The Texas Railroad Commission (RRC) has published proposed revisions to Statewide Rule 40 (16 Tex. Admin. Code. @ 3.40). The Proposal was officially published in the Texas Register on November 8, 2019.

    Per the RRC: "The Railroad Commission of Texas proposes amendments to @3.40, relating to Assignment of Acreage to Pooled Development and Proration Units. The amendments are proposed to allow the same surface acreage to be assigned to more than one well in an unconventional fracture treated (UFT) field when mineral ownership is severed at different depths below the surface." The proposed rulemaking also makes significant changes to the applicable notice requirements.
