    I am looking for someone that does or has done Solar Leasing in Texas.

    I have a client that has a 1/2 Und Min Int. in land in Central Texas.

    The Surface owner has all the Surface Int. and a 1/2 Und Min Int.

    The Solar Co. does not appear to be interested in building the solar
    farm unless the Non-Surface MI owner signs a Surface Rights Waiver or
    Surface Accommodation Agreement.

    The Solar Co. has not contacted the Non-Surface MI owner yet for some

    I am trying to find out the "usual" monetary compensation for the
    Non-Surface MI owner to execute a Surface Rights Waiver or Surface
    Accommodation Agreement.

    I've had a solar company contacting me off and on for the past 8 months or so about some minerals I own in Fayette County.

    Their representative keeps saying that an "engineering report" and an agreement is on its way to me.

    I haven't seen anything yet, and am curious about how they approach this.

    Value - to me- will be entirely dependent on what they propose.

    I understand there's proposed legislation on its way in Texas regarding solar and mineral rights, which I assume is an attempt to cut through mineral right dominance and the accommodation doctrine.

    I also would like to understand this better as well.  This article gives a decent overview.

    I am more interested in leaning all the practical aspects that one would need to know in terms of acting as a liaison for mineral owners in dealing with solar developers.  I've run across various agreements at the courthouse before, but in many instances, only a memorandum was filed, so you can't glean too much from them.  Anyone that comes across some good resources, please tag them to this thread.

    The most recent Section Report of the Oil, Gas & Energy Resources Law Section of the State Bar of Texas is devoted entirely to wind and solar.  There are articles on lease negotiations, financing, power purchase agreements, tax, renewable M&A, solar construction, renewable energy case law update, and mineral issue affecting solar.

    Below is a link to the website of Stoel Rives, LLC, a law firm active in the wind power industry. They offer a free PDF download of their book, The Law of Wind - 8th Edition, which has a chapter on Wind Energy Lease Agreements. The book should serve as a good primer on wind. I will let you know if I find a similar resource on solar.
