    As an update to a similar posting on January 23, on February 7, the Colorado Oil & Gas Conservation Commission (COGCC) released the remaining draft rulemaking to begin the process of implementing the state's oil and gas regulatory overhaul legislation (SB19-181), which was signed into law last year.     For background, the COGCC is considering amendments to the Commission Rules of Practice and Procedure, 2 C.C.R. 404-1, to implement SB19-181. On April 16, 2019, Governor Polis signed SB19-181 into law, which changed the mandate of the COGCC from fostering oil and gas development to regulating oil and gas development “in a reasonable manner to protect and minimize adverse impacts to public health, safety, and welfare, the environment and wildlife resources.” This rulemaking will change the rules and regulations governing the mandate of the Commission.

    The COGCC's February 7 notice of draft rulemaking details proposed changes to the 200, 300, 600, 800 and 900 Series rules which govern general provisions; operations and reporting; safety and facility operations; underground injection wells, and environmental impact prevention, respectively.     PUBLIC COMMENT: The COGCC is accepting public comment on the above noted draft rules through March 1, 2020. You may access the COGCC Public Comment Portal here:

    The COGCC is expecting final rulemaking to be released after July 1, 2020 with further draft rulemaking releases prior to that date, of which we will keep you informed as they are released for public review and comment.
